We, the Chartered Association of Business Schools, are registered in England and Wales as a limited company under company number RC000880 and as a registered charity with charity number 1162854. These terms apply when you use express your interest in, or apply for, the Programme. Please read them carefully.

By registering or applying you accept these terms

By registering your interest in, or applying for, the Programme, you confirm on behalf of your business that you accept these terms and that you and it agree to comply with them.

If you do not agree to these terms, you must not register your interest for, or apply to, the Programme.

We recommend that you print a copy of these terms for future reference.

By registering your interest in the Programme, you agree to receive further information from us about the Programme, including details about programme dates, providers and how to complete your registration.

You acknowledge that registering your interest does not secure you a place on the Programme.

We provide these terms on our own behalf and on behalf of the business schools which will deliver the Programme.  The contract for your place on the Programme will be between your business and the business school you enrol with.  The Chartered Association of Business Schools is not a party to such contract.

Application process and contract with business school

You will need to comply with the eligibility criteria outlined below and complete a registration form on our website when registration opens.  Your application will be processed by the business school you apply to.  That business school will assess your eligibility for the Programme and contact you to offer you a place or decline your application.  The contract between your business and the business school will be formed when the business school’s offer is accepted by you on behalf of your business. The Programme fee will then become payable to the business school.  At all times your business’s relationship in respect of the Programme is with the business school where you accept a place.

You must ensure that any information you provide in your application, and during the Programme, about you and your business, is true and correct.

Programme terms

By registering your interest in or applying to the Programme, you agree on behalf of yourself and your business that if your application is successful:

  • you will attend the full 12-week course. The duration may be extended up to 14 weeks to allow for break weeks.

  • a fee of £750 will be payable to the relevant business school. Your place on the Programme is conditional on the business school having received this amount in cleared funds from your business.

  • it is your responsibility to read the Programme description and determine whether it meets your requirements.

  • you agree to be contacted by a third party evaluator during and after the Programme. The name of the evaluator will be made known to you before they contact you.

the Department for Business, Energy and Industrial Strategy (BEIS) (which is providing funding for the Programme), the Chartered Association of Business Schools and the business schools delivering the Programme reserve the right to cancel or postpone the Programme or courses within the Programme at any time. Please see the Refund Policy outlined below:

the business school may need to change the content, structure, venue, timing, course directors/presenters of the Programme (for example if a venue is not available or in case of staff sickness or other absence).  The business school will endeavour to notify you of any such change as soon as reasonably practicable. We and the business schools will have no liability or obligation to you or your business for any such change, except as set out in the Refund Policy outlined below.

  • you will comply with the business school’s student code of conduct and any other reasonable instructions that they may give you.

  • the course materials used in the Programme have been collaboratively created for usage within this Programme only. You do not have the right to use these materials for any further training or as part of any other course(s). You will not license, distribute, publish, broadcast or otherwise circulate such materials. You agree on behalf of your business that it will indemnify us in respect of any loss suffered by us as a result of any breach of this paragraph.

  • online course and portal usernames and passwords are for your personal use only and should not be passed to anyone else. You should protect your log-in information at all times.

  • unless otherwise agreed between you and the business school, all facilities, amenities and equipment made available by it to you are only for the purposes of, and for the duration, of the Programme and must be used strictly in accordance with the business school’s instructions from time to time.

  • you will comply with the end user licence agreement for the learning platform used on the Programme.

If your application is successful and you participate in the Programme, you and your business agree to provide necessary information about your business, to help us evaluate the Programme. This will include, for example, information on your use of management practices and financial information relating to your business (such as turnover) before and after you have participated in the Programme. Data will be collected on registration, as part of a diagnostic before starting the Programme, and through surveys, some of which will take place after the Programme has finished.

Your business also agrees on request to complete a subsidy declaration called “Small Amounts of Financial Assistance” in a form to be provided by us or the business school, and shall retain records for six years after your participation in the Programme of all amounts received by your business that are state aid or public subsidies.

Business school’s obligations

The business school will:

  • deliver the Programme with reasonable care and skill and in a professional manner.

  • use reasonable endeavours to provide presenters, facilitators and mentors who are suitably qualified and experienced to deliver the Programme.

  • Use reasonable endeavours to ensure that the content of the course/Programme matches the Programme description.

  • award you with a certificate on completion of the course/Programme.

Eligibility Criteria

To join the Programme, you must be a decision maker or member of the senior management team within the business (such as Chief Executive, Finance Director or Operations Director).

In addition, your business must:

  • be a Small or Medium-sized Enterprise (SME) based in the United Kingdom;

  • be from any business sector, employing between 5 and 249 people;

  • have been operational for at least one year; and

  • not be a charity.

Cancellation / postponement of the Programme

The business school reserves the right to cancel or postpone the Programme, in whole or in part, without any obligation or liability to you or your business other than as set out in our Refund Policy outlined below.

The business school may also cancel your place on the Programme and terminate the contract without any liability to you or your business, if you or your business are in breach of these terms or the contract with the business school.

Refund Policy

Postponement, cancellation or termination by the business school

If the Programme is postponed or cancelled by the business school, the business school will endeavour to give you reasonable notice of such postponement or cancellation, and will refund the fee you have paid:

  • in full if the Programme is entirely cancelled; or

  • in part (pro rata) if only part of the Programme is cancelled or postponed.

If the business school terminates the contract because you or your business is in breach of these terms, the business school reserves the right to retain the full amount of the fee you have paid.

Withdrawal by you

If you withdraw from the Programme before the first session (because of, for example, illness, home schooling or bereavement), the business school will, at its discretion, give a full refund, transfer you to another cohort with the same school or permit you to transfer your place to a colleague from the same business.

If you attend the first and/or second session but you are unable to continue to session three (because of, for example, illness, home schooling or family bereavement), you may, at the business school’s discretion, transfer to another cohort with the same school at no further cost.

If you withdraw after the third session, you will not be entitled to any refund or to transfer to a new cohort or transfer your place to a colleague, except in extreme circumstances such as contracting Covid-19 symptoms or having to self-isolate in line with the UK Government’s guidance, a serious illness, death or family bereavement. In such cases, the maximum amount which will be refunded is 50%, and any such refund is at the sole discretion of the business school.

Your place on the Programme is not transferrable to a colleague except as provided in this Refund Policy and at the business school’s discretion. Any such colleague must meet the eligibility criteria and agree to these terms.

Intellectual property

All intellectual property rights (including copyright) in any course materials or other learning materials made available in connection with the Programme, whether online or in hard copy, belong to us or the business school, as applicable.

You agree that you will only use such materials for your private study and will not copy them (except for your private study).

Disruption of online access/technical support

We and the business school will not be responsible to you for any delay or disruption to your access to Programme materials as a result of any of the following:

  • operation of the internet (including the effect of viruses);

  • firewall restrictions which may have been placed on your network or the computer you are using to gain access to online study; or

  • the failure of telecommunications links or equipment or browser issues.

We accept only the obligations detailed below to provide technical and content support in connection with the Programme and its online platform.

  • If you report a fault to the business school, we will use reasonable endeavours to provide a solution, but we do not guarantee that the support provided will resolve your technical problems.

  • Periods of downtime may be necessary from time to time in respect of the platform used in the Programme. Technical support may not be available at such time. We aim to minimise any such downtime but will not have any liability for any periods of unavailability.

  • We cannot guarantee uninterrupted availability of online learning resources. In particular, we may suspend access to online resources for the purpose of scheduled or emergency maintenance, repairs and upgrades or to improve performance and functionality.

  • We will not be responsible for any problems or technical malfunction of any equipment or service not owned or operated by us, such as telephone networks or lines; computer systems, servers or providers; computer equipment or software; delayed or failed receipt of any email or online application due to technical problems or traffic congestion on the internet, telephone lines or any website; or any combination of these.

Accuracy of information about the Programme

Although we make reasonable efforts to update the information about the Programme, neither we nor the business schools make any representations, warranties or guarantees, whether express or implied, that the content we provide is accurate, complete or up to date, at any time.

Responsibility for loss or damage suffered by you or your business

Please note that we only provide information about the Programme to business users, and only businesses can apply to join the Programme.  If you are a consumer, you should not apply for the Programme.

We will not be liable for any loss or damage caused by any business school, whether in contract, tort (including negligence), breach of statutory duty, or otherwise.

Our liability, and the liability of the business school where you enrol, will be limited to the fee paid by your business for your place on the Programme.

Neither we nor any business school will be liable for:

  • loss of profits, sales, business, or revenue;

  • business interruption;

  • loss of anticipated savings;

  • loss of business opportunity, goodwill or reputation; or

  • any indirect or consequential loss or damage.

Nothing in this paragraph will exclude or limit our or any business school’s liability for: (a) death or personal injury caused by negligence; or (b) fraud or fraudulent misrepresentation; or (c) any liability that cannot be excluded or limited under applicable law.

Events outside our control

Neither we nor the business schools will be liable for any failure to perform, or delay in performing, any of our obligations under these terms that is caused by an event outside our or their reasonable control, including without limitation fire, flood, terrorist attack, civil unrest, strikes, epidemic or pandemic, lockdowns, or actions or delays by any government authority ("Force Majeure Event").

The business school’s obligations under these terms will be suspended for the period that the Force Majeure Event continues, and the time to perform these obligations shall be extended for that period. The business school will take reasonable steps to bring the Force Majeure Event to a close or to find a solution by which its obligations under these terms can be performed despite the Force Majeure Event.

We may make changes to these terms

We amend these terms from time to time. Please check these terms to ensure you understand the terms that apply at the time that you register your interest or apply for the Programme.

How we may use your personal information

We will only use your personal information in respect of the Programme as set out in our Privacy Notice – Help to Grow: Management Course, which can be accessed here.

We may use your personal information to enable you to be contacted by a course evaluator for feedback on the course. This may be during and/or after the Programme.
